Welcome to Black Wildflower! These Terms of Service ("Terms") govern your access to and use of the Black Wildflower progressive membership offered by Black Wildflower LLC ("we," "us," or "our") via our website at www.blackwildflowergarden.com (the "Service").
By accessing or using any part of the Service, you agree to be bound by these Terms. If you do not agree to all the terms and conditions of this agreement, then you may not access the Service.
1. Membership & Progressive Tiers
1.1 Membership Structure: Black Wildflower offers a progressive membership experience designed to guide you through a journey of self-discovery and transformation. Our membership consists of three sequential tiers:
* Tier 1: Insight Spark
* Tier 2: Conscious Connection
* Tier 3: Authentic Ascension
1.2 Progressive Access: You must begin your membership by subscribing to the Insight Spark tier. To access subsequent tiers (Conscious Connection and Authentic Ascension), you must first complete a minimum duration in the preceding tier, as communicated by Black Wildflower through email or within your member dashboard. Direct enrollment into Tier 2 or Tier 3 is not permitted.
1.3 Included Benefits: Each tier includes specific benefits as outlined on our website's membership page:
* Insight Spark: Downloadable guided meditations, printable worksheets & exercises, and a one-time basic handwriting analysis for new members.
* Conscious Connection: All benefits of Insight Spark, PLUS a physical journal and access to monthly live group meditation sessions.
* Authentic Ascension: All benefits of Conscious Connection, PLUS one-on-one coaching sessions and an annual in-depth handwriting analysis with a dedicated consultation.
2. Billing & Payments
2.1 Subscription Fees: Membership fees are charged on a recurring monthly basis at the rate specified for your chosen tier. By subscribing, you authorize us to charge your selected payment method.
* Insight Spark: $20/month
* Conscious Connection: $66/month
* Authentic Ascension: $250/month
2.2 Billing Cycle: Your monthly subscription will automatically renew each month on the date of your initial signup (or upgrade date for higher tiers) unless cancelled.
2.3 Payment Failure: If a payment fails, we will notify you and attempt to re-charge your payment method. If payment is not received within 7 days, your access to the Service may be suspended or terminated.
2.4 Upgrades: When you upgrade to a higher tier, your new subscription fee will be charged immediately, and your billing cycle may reset to the date of the upgrade. You will automatically gain access to the benefits of the new tier.
3. Cancellation & Refunds
3.1 Cancellation Policy: You may cancel your membership at any time through your Wix member dashboard. Cancellations will take effect at the end of your current paid monthly billing cycle. You will retain access to your tier's benefits until that time.
3.2 No Refunds: All sales are final for current and past membership periods. We do not provide refunds or credits for any partial membership periods, unused benefits, or non-participation in live sessions.
3.3 Limited Initial Refund (Insight Spark Only): If you are a new "Insight Spark" member and cancel within the first 7 days of your initial subscription, you may request a full refund. This applies only to your initial "Insight Spark" subscription and not to subsequent months or upgrades. During the 7 day period you will get a one time basic handwriting analysis for suggestibility and a glance into the worksheets and one access to one guided meditation recording audio.
4. Content & Intellectual Property
4.1 Ownership: All content provided as part of the Black Wildflower membership, including but not limited to guided meditations (audio/video), printable worksheets, journal content, group session recordings, handwriting analysis reports, and coaching materials, is the exclusive intellectual property of Black Wildflower LLC or its licensors.
4.2 Limited License: Upon active subscription, you are granted a limited, non-exclusive, non-transferable, revocable license to access and use the content for your personal, non-commercial purposes only.
4.3 Prohibited Actions: You may not:
* Share, distribute, resell, reproduce, modify, or publicly display any content from the Service without express written permission.
* Share your login credentials with others.
* Distribute links to member-only pages or live group sessions.
* Use content for commercial purposes.
5. Member Conduct
5.1 Respectful Community: We foster a supportive and respectful environment. You agree to treat all members and Black Wildflower staff with respect and courtesy, particularly during live group meditations.
5.2 Prohibited Activities: You agree not to engage in any conduct that is:
* Unlawful, harmful, threatening, abusive, or harassing.
* Defamatory, obscene, or racially/ethnically objectionable.
* Infringes on the intellectual property rights of others.
* Spamming, phishing, or distributing malware.
* Disruptive to the Service or other members' experience.
5.3 Termination: We reserve the right to suspend or terminate your membership immediately, without refund, if you violate these Terms or engage in conduct we deem harmful to the Service or other members.

6.1 Not Medical or Therapeutic Advice: The services provided by Black Wildflower, including hypnotherapy, guided meditations, coaching, and handwriting analysis, are for self-improvement, educational, and personal development purposes only. 6.2 No Guarantees: While we strive to provide high-quality content and support, we do not guarantee specific outcomes or results from the use of our Service. Individual results will vary based on effort, consistency, and personal circumstances.
6.3 Handwriting Analysis Disclaimer: Handwriting analysis provided is for self-insight and personal development purposes only. It is not a diagnostic tool for mental health conditions or a substitute for professional psychological assessment.
7. Limitation of Liability
To the fullest extent permitted by law, Black Wildflower LLC and its owner(s), employees, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from (a) your access to or use of or inability to access or use the Service; (b) any conduct or content of any third party on the Service; (c) any content obtained from the Service; and (d) unauthorized access, use, or alteration of your transmissions or content.
